Introduction

The Indian Independence Act 1947 was passed by the British Parliament on 18 July 1947. The Act provided the legal framework for ending British rule in the Indian subcontinent and transferring power to the people of the region. It led to the creation of two independent states, Pakistan and India. The Act came into effect in August 1947 and marked the end of nearly two centuries of British colonial rule.

Salient Features of the Indian Independence Act 1947

1. Creation of Pakistan and India

British India was divided into two independent Dominions: Pakistan and India.

2. End of British Rule

British sovereignty over the subcontinent came to an end.

3. Transfer of Power

Power was transferred to Pakistan on 14 August 1947 and to India on 15 August 1947.

4. Partition of British India

The Act approved the partition of British India into two separate countries.

5. Division of Punjab and Bengal

Punjab and Bengal were divided between Pakistan and India.

6. Establishment of Boundary Commission

A Boundary Commission was formed to determine the borders of the two new states.

7. Constituent Assemblies Empowered

Pakistan and India were authorized to make their own constitutions and laws.

8. Appointment of Governor-General

Each Dominion was to have a Governor-General to oversee the transfer of power.

9. Freedom for Princely States

Princely states were given the choice to join either Pakistan or India.

10. Division of Assets and Liabilities

Military forces, finances, government property, and services were divided between Pakistan and India.

11. Abolition of the Office of Viceroy

The office of the Viceroy was abolished, ending British political control.

Conclusion

The Indian Independence Act 1947 was a landmark law that ended British rule and provided the legal basis for the creation of Pakistan as an independent state. It marked the successful culmination of the struggle of the Muslims of the subcontinent for a separate homeland.
