Significance of the Objectives Resolution, 1949

Pakistan Studies E-Notes

Unit 3: Constitution of Pakistan

Subtopic 3.1: Objectives Resolution

SLO 3.1.4: Explain the significance of the Objectives Resolution, 1949

Introduction

The Objectives Resolution was passed by Pakistan’s Constituent Assembly on 12 March 1949, having been moved by Prime Minister Liaquat Ali Khan on 7 March 1949. It laid down the fundamental principles to guide the preparation of the future constitution, explaining the relationship between Islam, democracy, the rights of citizens, minority protection and the responsibilities of the state.

Its significance lies in the constitutional direction it gave the newly established country.

Significance

1. It provided a foundation for constitution-making

After independence in 1947 Pakistan needed a permanent constitution to establish the structure and powers of government. The Resolution gave the Constituent Assembly a set of guiding principles and helped define the political and constitutional direction to follow.

2. It established the Islamic character of the state

It declared that sovereignty over the entire universe belongs to Allah Almighty and that the authority exercised by the people of Pakistan is a sacred trust, and that Muslims should be enabled to order their lives according to the Quran and Sunnah. This gave an important basis for incorporating Islamic principles into the constitutional system.

3. It linked Islamic principles with democracy

State authority was to be exercised through the chosen representatives of the people, and democracy, freedom, equality, tolerance and social justice were to be observed. It thus set out a framework in which representative government would operate alongside the Islamic principles it recognised.

4. It emphasised fundamental rights and social justice

It recognised fundamental rights, including equality before the law and freedom of thought, expression, belief, faith, worship and association, subject to law and public morality, and emphasised social, economic and political justice. These principles provided a basis for protecting citizens’ rights and guiding the state towards a more just society.

5. It protected the rights of religious minorities

Minorities were to be free to profess and practise their religions and develop their cultures. This was significant because Pakistan was home to citizens of different religious communities, and it made minority protection a constitutional principle and recognised the state’s responsibilities towards all its citizens.

6. It supported an independent judiciary

An independent judiciary helps interpret the constitution, apply the law and protect citizens’ rights, and allows disputes to be settled according to law rather than the wishes of those in power.

7. It provided a basis for the federal system

It supported a federation whose units would have powers within the constitutional framework. This mattered because Pakistan had two geographically separated wings with different social, cultural and economic conditions, and federal principles offered a way to organise the state while recognising regional interests.

8. It influenced Pakistan’s later constitutions

Its principles influenced the preparation of the constitutions of 1956, 1962 and 1973, although these differed in arrangements and provisions. It remained an important reference point in Pakistan’s constitutional history.

9. It became a substantive part of the Constitution

It acquired a special constitutional position when it was incorporated into the 1973 Constitution through Article 2A in 1985, giving its principles a formal place in the constitutional framework rather than leaving them as a statement of the Constituent Assembly’s intentions.

Conclusion

The Objectives Resolution of 1949 was a major step in Pakistan’s constitutional development. It provided guiding principles for constitution-making, defined the intended relationship between Islam and democracy, recognised fundamental rights, supported minority protection and emphasised judicial independence and federalism. Its incorporation through Article 2A in 1985 strengthened its constitutional significance. Although the practical implementation of its principles remains a subject of debate, it continues to be an important document for understanding Pakistan’s constitutional and ideological development.
